NJ post McDonald

I’m not too sure what to expect.  I really expect nothing to change.  It will take lawsuits, which take money.  I’m just very surprised that, currently, there are so few gun related bills introduced to the NJ Legislature.  Cause the way NJ Government seems to work is: Don’t like it?  Too bad.  Take us to court.  Which leads us back to needing money for lawsuits post-McDonald. I figured bills would be filed like there was no tomorrow.

If McDonald is a bust, I see the screws gettin’ awfully tighter here.

    Yep, if McDonald is a bust, I’ll be working on my arguments for convincing my wife that moving out of New Jersey would be a good thing. I’ll never get her all the way to Texas, but just across the border in Pennsylvania wouldn’t be bad.

    I can’t imagine there’ll be any legislation to fix the gun laws here until there’s a solid decision in McDonald (assuming it goes our way.) And even then probably not, so it’ll have to be lawsuits.

    This is where I worry about Sotomayor’s questions about “reasonable regulation”. If that language shows up in the result, NJ will no doubt argue that all of its regulation as reasonable.

  2. Assuming McDonald goes the right way, NRA may take more of an interest in us since we’ll have some winnable test cases. It’ll be a long road, but I think we’ll _probably_ end up with some kind of carry (though probably subject to lots of “common sense” restrictions), and dismantling the pistol permit process. The second is less certain, SCOTUS-wise, but since the state already seems lukewarm on it, we may end up with just normal NICS checks, like most of the rest of the country.

    I wouldn’t expect much more than that, unfortunately.

    I think I saw an ad soliciting plaintiffs for some test cases.

    I know I’ve seen legislation proposed to just go with NICS on *cost-cutting* grounds. That’s something that might happen in this climate anyway, given the magnitude of the budget hole.
